Supreme Court Throws Out Industry Appeal of Obama-Era Net Neutrality Rules

The Supreme Court decided on Monday that it will not consider a series of challenges from telecom companies to Obama-era net neutrality rules created to bar internet service providers from manipulating loading speeds for specific websites or apps.

Late Monday the Justice Department announced it was bypassing regional appellate benches and going straight to the high court to gain support for its effort to end the Obama-era Deferred Action for Childhood Arrivals (DACA) program.

The U.S. Supreme Court has decided not to review a challenge made by the telecom industry against the original rules for net neutrality that were decided on during the Obama-era.

The Trump administration had warned that it would ask the high court to step in if the appeals court didn't rule by October 31.

Should the Supreme Court refuse his request, Francisco pointed out, the administration would be required to continue accepting DACA applications while waiting on California's ninth circuit to rule on the legality of ending the program.

It takes four of the nine justices to agree to hear a case. The Supreme Court also declined to remove the precedential value of the D.C. Circuit's 2016 opinion. The policy reversal went into effect in June.

A divided high court refused and instead simply rejected the appeals, leaving the 2016 ruling in place.

The Federal Communications Commission voted previous year to revoke those rules.

The new rules, which gave internet service providers greater power to regulate the content that customers access, are now the subject of a separate legal fight after being challenged by numerous groups that backed net neutrality. Justice Kavanaugh and Chief Justice John Roberts recused themselves from the vote. "There was absolutely no reason for the Supreme Court to take this case, and today's denial puts to bed the chances of upending the correct appellate-court decisions".

It also aimed to remove the lower court's verdict from the books so that it couldn't be used as a precedent, something that could prove significant given the ongoing legal actions that challenge the FCC's 2017 repeal of net neutrality. The Pai-led FCC is defending its net neutrality repeal against a lawsuit filed by dozens of litigants, including 22 state attorneys general, consumer advocacy groups, and tech companies.
