Trump's Supreme Court nominee Kavanaugh woos Senate

President Trump introduced Brett Kavanaugh as his nominee for Supreme Court Justice ceremony yesterday

While Kavanaugh was summarizing Rehnquist's thinking and not explicitly adopting it as his own (nor did he say whether he interprets stare decisis to mean Roe should survive regardless of that critique), his summary of Roe as "freewheeling judicial creation of unenumerated rights" may be the clearest indicator yet that he thinks the case was wrongly decided.

Kavanaugh also wrote that the Constitution already provides a check on executive power, because an impeached president is then subject to criminal prosecution.

As promised, Trump made his pick from a list of more than two dozen potential nominees drawn up with the help from conservative legal activists at The Federalist Society and The Heritage Foundation.

But any Republican defections could be offset by centrist Democrats campaigning for re-election in conservative-leaning states Trump won handily in 2016.

"From what I know at this point, it appears President Trump has made an excellent choice in nominating Brett Kavanaugh", Aderholt, R-Haleyville, said in a statement. The letter, which includes 150 signatures, was addressed to Majority Leader Sen.

"I think you want to go as quickly as possible", Trump said.

"What Senator Schumer was saying was really insulting and offensive to the president", Leo said of the Senate minority leader on Your World.

No confirmation hearings have yet been scheduled for Kavanaugh but the judicial nominee is scheduled to meet with Orrin Hatch of Utah, a seven-term senator and former chair of the Senate judiciary committee, on Wednesday. Thomas, at 70, is the oldest of the court's remaining Republican appointees.

Republicans and Democrats are at odds over Kavanaugh and with the Senate closely divided, his path to confirmation is treacherous.

Outside the Supreme Court on Monday night, hundreds of people protested heatedly over Kavanaugh's nomination. This nomination is one of the most important items that we will consider this year. Kavanaugh is Trump's second nominee, giving the president a chance to solidify conservative control of the court for years to come.

"I will oppose this nominee with everything that I've got", Schumer told MSNBC, warning that a more conservative court including Kavanaugh could overturn the landmark 1973 Roe v. Wade ruling legalizing abortion and end protections under the Affordable Care Act healthcare law known as Obamacare.

"The people who are on the wrong side of the culture are the Left", he said. But almost all Senate Democrats and many Democratic voters are expected to oppose Trump's nominee.

By keeping Scalia's seat open, McConnell gave Trump a head start in putting his own stamp on the high court, and the president acknowledged as much when Gorsuch was sworn in a year ago. Progressive stalwart Sherrod Brown of OH said: "I will make a decision after meeting with him".

Meanwhile the anti-gay National Organization for Marriage - which has long advocated a strategy of stacking the Supreme Court with conservatives in order to undermine rulings on LGBT equality - is jubilant at the pick. So far, Trump has installed more than 20 appeals court judges and more than 16 trial court judges on the federal bench.
